Mr D was a cyclist who was travelling to the station one morning to catch a train to work.
As he was cycling along the road there was a side road on his right. A car pulled out of the side road over on to Mr D’s side of the road and knocked him off his bicycle.
He sustained an injury to his left elbow and knee and was taken to hospital by ambulance.
He was absent from work for 4 weeks and required physiotherapy for the injury to his knee. He went on to make a full recovery from his injuries.
The driver of the car argued that he had not seen Mr D as he pulled out of the side road, but since Mr D had right of way on the main road we were able to show that the accident was the fault of the car driver in not taking care to check the road before pulling out.
We successfully obtained compensation for Mr D of £14,000.
